UNIVERSAL JUSTICE STATES "DO TO OTHERS AS YOU WOULD LIKE OTHERS TO DO TO YOU" OUR LEADERS SHOULD BE REASONABLE IN HANDLING NIGERIAN ISSUES.

WE SHOULD BEAR IN MIND THAT ALL THE PEOPLE EXISTED BEFORE NIGERIA WAS JOINED IN 1914.

WE SHOULD ALSO REMEMBER THAT THE LAND USE ACT WAS ANOTHER CREATION OF MAN IN 1978. ALL THESE WAS NEVER A CREATION OF GOD. 

SO WHY DO GOVERNMENT FIND IT SO DIFFICULT IN PUTTING NIGERIA TOGETHER AND AVOID ALL THESE CRISES? 

DO NIGERIANS CONTINUE TO BE KILL OVER AN ISSUE WE CAN COME TOGETHER AND RESOLVE.

HOW DEMOCRATIC ARE WE WHEN WOUNDED PEOPLE CANNOT BE APPEASED AND THEIR WOUNDS HEALED.

WHY ARE WE INFLICTING MORE WOUNDS ON OURSELVES?

CAN WE JUST ALLOW GOD TO HAVE HIS WAY WHEN ALL OUR EFFORTS HAVE FAILED AS NIGERIANS AS OUR LEADERS HAS FAILED US.

FOUNDATION OF JUSTICE

GOD, THE SOURCE OF JUSTICE

SECTION 36(1) of the Constitution of the Federal Republic of Nigeria 1999 as amended states that "in the determination of his civil rights and obligations, including any question or determination by or against any government or authority, a person shall be entitled to a fair hearing within a reasonable time by a Court or other tribunal established by Law and Constituted in such manner as to secure its independence and impartiality. 

From this section the age long principle of natural justice of fair hearing is derived.

This is part of the pillars that support the concept of the rule of Law.

In our administration of justice we have two pillars that support fair hearing :-

1.  AUDI ALTERAM PARTEM RULE:- This is a Latin maxim that says that a party to any dispute must be heard before a decision can be given against him. 

2.   NEMO JUDEX IN CAUSA SUA :- Which means no one should be a Judge in his own cause. 

Any breach of these principle result in the nullity of the entire proceedings no matter how well conducted it may appear. 

A hearing/trial can only be said to be fair when all parties to the dispute are given a hearing or an opportunity of a hearing. 

These two pillars was copied from the principles laid down by God in Adam and Eve trial in the garden of Eden and Cain's trial after murdering his brother. 

God gave Adam and Eve a fair hearing in the garden. 

He did not condemn before hearing from them. 

He allowed them to defend themselves by stating their own side of the story. 

Serpent was punished for misleading them with his evil intention and misleading them with lies. 

Adam was punish for having an intention to eat and for eating the fruit. this is the principle of Law called the ACTUS REUS and MENS REA. God computed intention to eat the fruit to Adam that is why his blame on Eve did not exonerate him. He could not prove it was a mistake, or he was asleep or drunk or alibi (not being around) or an accident. As for Eve her intention and action to eat was complete and so God's punishment came on all.

As for Cain, the innocent blood cried to God for vengeance before God descended to try Cain. 

God also warned him before he committed the offence and after that God tried him by asking him a simply question " where is thy brother". His answer betrayed him and show total hatred of his brother. God passed this judgment on him and he appeal to God that his sentence is too harsh on him, that being a wanderer on earth people will kill him, so God place a mark on him to prevent him being killed as he wanders about.

That is why when people are convicted the Judge orders for allocutors in our court so that the Judge can mitigate  or reduce the punishment. 

In Our Testament God committed all advocacy and Judgement to Christ, to avoid being bias (that is being a Judge at his own course) while Satan is the prosecutor. That is why we adopted accusatorial legal system. 

The prosecutor accuses and proves their case beyond reasonable doubt. with these submission I think I have been able to convince you that our constitution pivot from the Holy Bible and must be treated with sacrosanct and the principles therein observed with fear and trembling by the courts or face God's wrath at the end of the day.

LAW OF THE ADMINISTRATION OF THE JUDGES.

DEUTERONOMY 16: 18-20, "Appoint judges and officials for each of your tribes in every town the Lord your God is giving you and they shall judge the people fairly. Do not pervert justice or show partiality. Do not accept a bribe, for a bribe blinds the eyes of the wise and twists the words of the righteous. Follow justice and justice alone, so that you may live and posses the land the Lord your God is giving you."

GOD'S PREFERENCE  OF JUSTICE TO PRAYER AND FASTING.

ISAIAH 58:6, "Is not this the kind of fasting I have chosen; to loose the chains of injustice and untie the cords of the yoke, to set the oppressed free and break every yoke?"

WOE TO THOSE THAT DO INJUSTICE.

ISAIAH 5: 21-23, "Woe to those who are wise in their own eyes and clever in their own sight, Woe to those who are heroes at drinking wine and champion at mixing drinks, who acquit the guilty for a bribe but deny justice to the innocent.

PROVERB 17;15, "Acquitting the guilty and condemning the innocent, the Lord detests them both"

OUR MAGISTRATES AND JUDGES SHOULD TAKE NOTE OF WHAT GOD IS SAYING HERE BECAUSE THEY WILL ACCOUNT TO GOD.

THE DAMOCLE OF OFFICIAL CORRUPTION.

JUSTICE AND ITS' HAMMER IN FOCUS.

Section 36 (5) of the Constitution of the Federal Republic of Nigeria 1999 as Amended provides that "Every person who is charged with a criminal offence shall be presumed to be innocent until he is proved guilty".

The word SHALL is used in this provision which means MUST but has been abused by some courts.

The abusers have their own spirit and intent in application of this provision.

Some propounded their own theories, views and became judgmentally bias. 

Some presumed the suspect or defendant guilty of the charge and thereby granting condition of bail that is stringent and amounted to no bail.

Some reasoned that if granted simple bail they will easily be lay off the hook and will always relapse back to crime.

Another set of bias judges and magistrates are those that went out to avenge themselves on these suspects or defendants because of the ordeal they pass through under them and each time they are brought before them there is hard condition or denial of bail even when the charge is bailable. The most unfortunate is that before they are released bribe will exchange hand.

It is unfortunate that a magistrate was demoted recently  at Igboshere Magistrate Court Lagos for bribery. A reliable source once told me a story that she normally give hard condition of bail to fraud stars because she had a bad experience in their hand as a school young girl. Each time she give hard condition  the release will take place in her office.As this event continued the blood stream became contaminated and at the fulness of time the invisible hand of exposure hammered.

My headache and heartache has refussed to heal because this person is very intelligent and a judge material.

Worst of it all is that the family burden is upon her shoulder, but must not be an excuse.

I call on my fellow women to vigorously pray for her because of her seeds. That the Lord should forgive her and erase this from the book of evil one who knows how to plan the down fall of men years ahead before striking his ugly arrow.

This is one of the ways Adam silently push Eve to the serpent now she has eaten the fruit with him hope he will not now lay blame on her because she need encouragement not blame after all he was with her while she pucks the forbidden fruit.

FORGIVE YOUR ENEMIES, DO NOT TAKE REVENGE, OBEY THE CONSTITUTIONAL PROVISIONS, IT IS THE PRINCIPLES OF GOD. THE MEASURE YOU USED IS THE MEASURE GOD WILL USE AGAINST YOU.

PERSONAL OBSERVATION!

I observe that crime and offenses has increased this days. 

Religion will call it end time, while circularity will say it is government negligent duty of care to its teaming population.

More of assault  and battery has been on the increase with stabbings and wounding. I know that the recent conditions in the country is to be blamed, because idle mind is the devils workshop.

But do we need to kill ourselves before the expected glory? for i know that with patient we can make it as a divided or indivisible nation.

WHAT IS JUSTICE?

SHOULD JUSTICE BE DISCRETIONARY OR ACCORDING TO LAW?

SHOULD JUSTICE BE DISCRIMINATORY BETWEEN THE RICH AND THE POOR?

WHAT'S YOUR OPINION ON THIS BOILING ISSUES IN NIGERIA?

NIGERIANS CAN STILL FIX THE NATION

Granting of bail by our court and the Court demanded three years tax from the sureties.

My first question, is three years not a retrospective punishment?

Secondly when the defendant is a youth and have no job, is this demand from our Courts not a punishment to him, seing that he cannot afford it.?

Or thirdly is this requirement a punishment for the sureties who have no part in the defendant's guilt that is not yet proved.?

What is Justice?

Is our Courts also trigger happy shooting even when the law, precedent a and practice is against it.

If the Constitution said that a defendant if innocent until proven guilty nothing shall constitute a chain on his freedom.

OR WHAT IS YOUR OPINION?

Discretionary justice or according to law.

WHAT IS JUSTICE?
Number 1 meaning of justice is "The fair and proper administration of Law" (Blacks Law Dictionary 9th Edition.)
Example: a first offender was brought to court, on the process became afraid and tried to run away from court. He was arraigned for trying to evade justice and was sentenced to seven years imprisonment.
Another was brought to court and he too was a first time offender, he became afraid of what is before him and tried to escape and was caught. On arraignment he was sentence to six weeks imprisonment and a community service to wash public toilet.
Can you reason on the type of justice playing out here? whats your disposition on these two judgments.?
